In addition to maintaining a strict confidentiality agreement with my clients, this Privacy Policy explains how and why I collect, use, and protect your information when you visit and engage with my websites and web applications (collectively referred to as the “Sites”), including jonathansoltero.com and soltero.now.
This Privacy Policy applies to all visitors, clients, and users of my Sites and services. By using my Sites, you consent to the practices described in this policy.
By using my Sites and services, you confirm that you are of legal age (at least 18 years old or the age of majority in your state or province of residence). You are responsible for your own online activities, and by accessing or using my Sites, you consent to the collection and use of derivative data (technical information such as IP address, browser type, etc.) that is necessary for me to operate and provide my website and services.
When you voluntarily fill out a form and provide your email address, you consent to receive emails from me, including newsletters, session updates, order confirmations, and other communications related to my services.
Similarly, when you provide your phone number, you consent to receive text messages or calls from me for purposes such as scheduling, customer support, or order updates.
When you provide any other personal information (such as your name, address, payment details, or government ID for age verification), you consent to my collection, use, and processing of that information as described in this Privacy Policy.
You may withdraw your consent for marketing communications (emails or texts) at any time by clicking the unsubscribe link in any email or by contacting me directly. Note that withdrawing consent for marketing will not affect the processing of information needed to provide the services you requested, such as client gallery access or order fulfillment.
I may collect information about you in a variety of ways when you access my Sites and services. This includes, but is not limited to, when you fill out forms, subscribe to my newsletter, enter sweepstakes or giveaways, or respond to polls, questionnaires, and surveys.
I collect two main categories of data:
Derivative data is information that my servers and software automatically collect when you visit my Sites or interact with forms. This includes your IP address, browser type, operating system, access times, referring URL, and the pages you have viewed.
Personal data is information that you voluntarily provide to me, such as your name, email address, phone number, mailing address, and demographic details (for example, age, relationship status, or interests) that you submit through forms or that may be publicly available.
CLIENT GALLERIES
When clients access my private client gallery, I require them to create an account by providing their full name and email address. This allows me to verify their identity, grant secure access to their personalized gallery, and communicate with them about their photos, gallery updates, and related services.
Once logged into their client gallery, clients may place orders for physical or digital products (such as prints, albums, or other photo products). To process and fulfill these orders, I collect additional information, including:
I collect this information directly from you when you voluntarily provide it during account registration or at checkout.
Important note on payment data: I do not store your full credit card information on my servers. All payment processing is handled securely by my third-party payment processor, Stripe. You can review Stripe’s privacy practices in their privacy policy.
This data is necessary for me to complete your registration, provide access to the client gallery, process your orders, arrange shipping, send order confirmations and invoices, and provide customer support related to your purchases.

If applicable to certain content or sessions, federal law under 18 U.S.C. § 2257 requires me to obtain and maintain records to verify that individuals appearing in specific visual depictions are at least 18 years old. In these cases, I may collect a copy of a government-issued photo ID (such as a driver’s license or passport), along with your date of birth and full legal name (including any stage names or aliases you use).
This information is securely stored in a private database for a minimum of seven years as required by law. When uploading your ID, you may redact sensitive details such as your home address or Social Security number, leaving only your photo, name, date of birth, and ID type/validity information.
I do not and will never sell your data. It is my goal to keep everything confidential between you and me, but I may share some data in certain situations. Your information may be disclosed as follows:
BY LAW OR TO PROTECT RIGHTS
If I believe the release of information about you is necessary to respond to legal process, to investigate or remedy potential violations of my policies, or to protect the rights, property, and safety of others, I may share your information as permitted or required by any applicable law, rule, or regulation. Such as when exchanging information with other entities for fraud protection and risk reduction.
ONLINE PUBLIC POSTINGS
When you post comments, contributions, or other public content to the Sites, your posts may be viewed by all users and may be circulated outside the Sites in perpetuity.
THIRD-PARTY SERVICE PROVIDERS
Some of your data may be stored or utilized by third parties that perform services for me or on my behalf, such as analytics, email delivery, hosting, cloud storage, and payment processing. These third parties may have access to your data as necessary to perform their functions, but they are not permitted to use it for other purposes.
I conduct extensive research to find service providers that uphold high standards for security, privacy, and data protection. Even so, I make sure to strip extremely personal and personally identifiable data when possible before data passes through these third-party services.
In the event of a data breach or mishandling of your data by these third parties, I will take appropriate steps to notify you and address the issue in accordance with applicable laws and regulations.
I may use cookies, web beacons, tracking pixels, and other tracking technologies on the Sites to help customize the Sites and improve your experience. When you access the Sites, your personal information is not collected through the use of tracking technology. Most browsers are set to accept cookies by default. You can remove or reject cookies, but be aware that such action could affect the availability and functionality of the Site. You may not decline web beacons; however, they can be rendered ineffective by declining all cookies or by modifying your web browser’s settings to notify you each time a cookie is tendered, permitting you to accept or decline cookies on an individual basis.
I may need to include a tracking pixel to monitor the effectiveness of information or materials I share. For example, you may subscribe to my email list, which may be used for advertising purposes. Emails sent may contain tracking pixels. The pixel is embedded in emails and allows for an analysis of the success of online marketing campaigns. Because of these tracking pixels, I may see if and when you open an email and which links within the email you click. Also, this allows my Sites to adapt the content of future emails to the interests of the user. I do not share this information with third parties.
INTERNET-BASED MARKETING
I use third-party software to implement email marketing campaigns and manage other interactive marketing initiatives. This third-party software may use cookies or similar tracking technology to help manage and optimize your online experience on the Sites.
WEBSITE ANALYTICS
I partner with selected third-party vendors, such as Google Analytics, to allow tracking technologies and remarketing services on the Sites through the use of first-party cookies and third-party cookies, to, among other things, analyze and track users’ use of the Sites, determine the popularity of certain content and better understand online activity. By accessing the Sites, you consent to the collection and use of your information by these third-party vendors. You are encouraged to review their privacy policy and contact them directly for responses to your questions. I do not transfer personal information to these third-party vendors. You should be aware that getting a new computer, installing a new browser, upgrading an existing browser, or erasing or otherwise altering your browser’s cookies files may also clear certain optout cookies, plugins, or settings.
To protect your personal information, I take many precautions and follow industry best practices so that your data is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.
Your information is encrypted using secure socket layer technology (SSL) and stored with AES-256 encryption. Do keep in mind that no matter what website you visit no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, I cannot guarantee the complete safety of provided personal information.
Sites may contain links to third-party websites and applications of interest, including external services, that are not affiliated with me. Once you have used these links to leave the Sites, any information you provide to these third parties is not covered by this Privacy Policy, and I can not guarantee the safety and privacy of your information. Before visiting and providing any information to any third-party websites, you should inform yourself of the privacy policies and practices (if any) of the third-party responsible for that website, and should take those steps necessary to, in your discretion, protect the privacy of your information. I am not responsible for the content or privacy and security practices and policies of any third parties, including other sites, services, or applications that may be linked to or from the Sites.
I may engage in affiliate marketing, which is done by embedding tracking links into the Sites. If you click on a link for an affiliate partnership, a cookie will be placed on your browser to track any sales for purposes of commissions. As part of affiliate marketing, the Sites may post customized links to track referrals from links placed on the Sites. Affiliate programs utilize cookies to track visits for the purposes of assigning commission on these sales. There is no fee or cost to you; the retailer or network pays the commission.
